These online shopping terms and conditions apply to all orders which you, the customer, place using this website “www.honeyant.com.au” operated by us.

Please read them carefully before placing your order and print a copy for your future reference.

By clicking on the “Accept” button you accept and agree to be bound by these Online Shopping Terms and Conditions, the Privacy Statement and any other policies we notify you of from time to time, which together constitute the entire agreement between us. Nothing in these Online Shopping Terms and Conditions affects your statutory rights, either as a consumer or otherwise.

Orders for Delivery Outside Australia

If you choose to access this website from locations outside Australia, you are responsible for compliance with local laws if and to the extent local laws apply.

Customs Duties

Customs duties may be payable in some countries and International customers are responsible for the payment of any duties and taxes applicable for the importation of our products into your country. As we have no control over these charges and cannot predict what they may be, we recommend you contact your local customs service for more information. Customs may also inspect goods prior to delivery, which may cause a delay to the delivery of your items.

Photographic Reproduction and Product Sizes

Whilst we have photographed our products to the highest quality possible, it is possible that the colours that may be shown on your computer monitor may not accurately reflect the actual colour of the product delivered. The sizes of products shown on our website may change from time to time without notice.

Availability of Products

From time to time, a product shown on this website may be temporarily out of stock. This will be shown on the website and you will be unable to order that item until stocks are renewed.

When you provide your confidential personal details to us, it is your responsibility to ensure the protection of your account username and password so that your details are not used by unauthorized people. Should unauthorized use of your account and password occur, it is a condition of your use of this website that you agree to accept responsibility for any items and charges purchased on this website using this information. You can update your registration details at any time and it is your responsibility to provide us with any changes to your email or postal address. We reserve the right to refuse access to this website, terminate accounts, remove or edit content or cancel orders at our discretion, which will be undertaken at no charge to you.

By using this website, you therefore agree that electronic communications from us to you will be the accepted method of communication should there be a legal requirement to do so.

Our Contract

By placing an order on this website to purchase items, you have made an offer to purchase those items. At the time of Check-Out on this website, you will be shown a summary of those items you have selected to purchase (“order confirmation”). The contract between us is formed at the time when you provide your payment details

Prices Are Subject to Change Without Notice

All prices on this website are in Australian Dollars (AUD$) and where applicable, are noted as including Goods and Services Tax (GST). Products are invoiced in AUD$ at the price prevailing at the time you place your order. Freight charges are extra and will be displayed at the Check-Out prior to payment, according to your delivery address. Prices displayed on our website apply to online purchases only and do not necessarily reflect the price of identical items sold by any other means. We reserve the right to update prices displayed on the website from time to time.

Payment

You may pay for the items that you order online by the following methods:
• Paypal
• Direct funds transfer
We regret that we are unable to accept cheques or cash as payment online. When you place your order, our system automatically asks your card provider to authorise this amount. If we get a valid authorisation, your card provider will hold this value expecting a charge from us. Receipt of your credit card details and debit of payments does not constitute our acceptance of your order. As we cannot guarantee the security of data sent to us by email, we are therefore unable to accept payment information by email. We will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information you provide us when placing an order.

Returns

If you receive a package from us and the contents have been damaged in transit, please do not take delivery of the item, but advise the courier to return the package to us. Upon receipt of the goods from the courier company, we we will exchange the damaged items without charge to you.

Defective Items

You have the right to return a faulty item to us, however this must occur within thirty (30) days from the date of delivery. Returns will only be accepted with your proof of purchase. For details on how to return your goods, please email us.

Incorrect Items

If we have sent you an incorrect item, please notify us by email within thirty (30) days of receipt of the goods. We will then advise you how to return the incorrect item to us with your proof of purchase, and specify the correct details in writing. If you would like us to replace the incorrect item with the item you ordered we will send you the correct item as soon as possible. We will not charge you for the incorrect item and will reimburse your reasonable costs in returning it.

Costs

We will reimburse any reasonable costs you incur in returning the following items to us:
• items we delivered to you in error
• items which were damaged on delivery or are defective or incorrect
You will be responsible for the costs of returning items to us in all other circumstances. If we do not receive the original item back from you with the delivery slip, we may arrange for collection of the item from the delivery address at your cost. Until you return items to us you are responsible for their safe keeping and taking reasonable care of them. We do not accept liability for returned packages damaged during transit back to us. It is your responsibility to wrap products adequately to prevent damage.

Losses

We will be responsible for any losses you suffer as a direct result of us breaching these Online Shopping Terms and Conditions if those losses were reasonably foreseeable to both you and us at the time the contract for the sale of items by us to you was formed (i.e. at the Check-out point). We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our sub-contractors or agents, is consequential or was not reasonably foreseeable to both you and us when the contract between us was formed. Our liability to you under these Online Shopping Terms and Conditions will not exceed the total price charged for the items purchased.

Events Beyond our Reasonable Control

We will not be responsible to you for any delay or failure to comply with our obligations under these Online Shopping Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.

Alterations to this Website and Terms and Conditions

We reserve the right at any time to make changes to this website, these Online Shopping
Terms and Conditions, Privacy Statement and such other policies. You will be subject to the policies and terms and conditions in force at the time you order items from the website. Changes that we are required to make by law could apply to orders you have already made. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, the contract will be deemed severable and not affect the validity and enforceability of the remaining terms and conditions.

Governing Law and Jurisdiction

The Online Shopping Terms and Conditions for this website are governed by and construed in accordance with the laws of Australia and you therefore agree to the exclusive jurisdiction of the Australian courts, as do we.

Freight

The prices shown on the website are in Australian dollars (AUD$) and where applicable, include GST (Goods and Services Tax) for Australian Domestic Customers, as well as for International customers that require delivery to recipients within Australia. We invite you to shop online and when in the Check-Out process, click on the ‘Freight Charges’ button to obtain the relevant postage charges for the items in your Shopping Cart. We do not have a minimum order requirement, however the cost of postage, particularly for International customers, is more cost effective when several items are purchased. Insurance is recommended on all International orders.

Australian Postage Charge Estimates

In Australia, we use Australia Post and offer ‘flat price’ freight rates. We aim to mail out the goods within 7 working days.
